Limited
Warranty
Raised Panel, Louver, Board & Batten & Bahama Shutters
Atlantic
Shutter Systems, Inc. warrants to the original purchaser, PVC and
Fiberglass Shutters against defects in materials and workmanship for a
period of ten years from the date of purchase so long as the warranty
holder is not in default on any obligation to Atlantic Shutter Systems,
Inc.
Atlantic
Shutter Systems, Inc. warrants against rotting, splitting and excessive
warping under normal use.
Atlantic
Shutter Systems, Inc. warrants factory paint finishes will not peel or
flake for a period of ten years from the date of purchase.
EXCLUSIONS:
Atlantic
Shutter Systems will not be held responsible for any product damaged by
Acts of God, accidental or intentional damages, improper installation,
repairs or modifications by person not authorized by Atlantic Shutter
Systems or by the use of parts and accessories not authorized by Atlantic
Shutter Systems. Atlantic Shutter Systems will not be held
responsible for water seepage through closed shutter systems during strong
wind and rain. Atlantic Shutter Systems will not be held responsible
for normal weathering of any painted surface.
LIMITATION
OF WARRANT:
Except
as set forth in this warranty, Atlantic Shutter Systems, Inc. makes no
warranty expressed or implied as to the merchantability or fitness for any
particular purpose of the products. Atlantic Shutter Systems will in
no event be liable for consequential or incidental damages arising out of
any breach of any express or implied warranty. Atlantic Shutter
Systems liability will not exceed the original purchase price of the
shutter excluding installation, freight and taxes. Some states do
not allow limitations on implied warranties or the exclusion or limitation
of consequential or incidental damages, so the above limitations and
exclusions may not apply to you. This warranty gives you specific
legal rights and you may also have other rights which vary from state to
state.
REMEDIES
AND CLAIMS PROCEDURE:
At
Atlantic Shutter Systems' sole option, any products found to be defective
will be either repaired, replaced or refinished provided that the
defective shutter is returned freight pre-paid to Atlantic Shutter
Systems, Inc. Atlantic Shutter Systems, Inc. will not be responsible
for incidental charges including but not limited to the cost of removal
and re-installation of shutters that are the subject of warranty claims.
Any
claim under this warranty must be made in writing and postmarked within 30
days after discovery of the defect to: Atlantic Shutter Systems,
Inc., 3239 Highway 301, Latta, South Carolina 29565 attention:
Warranty Department. Atlantic Shutter Systems must be allowed a
reasonable opportunity to determine and fulfill its obligations under this
warranty before the others make any repairs. Atlantic Shutter
Systems, Inc. expressly disavows any responsibilities for repairs made by
a third party.
Atlantic
Shutter Systems shall solely determine whether proper installation was
made, whether any warping is excessive for purposes of the warranty, and
whether any complaints related to finishes are beyond normal weathering
and therefore warrantable.
Purchaser
shall bear the burden of proving to Atlantic Shutter Systems' reasonable
satisfaction the date of purchase and that Purchaser is in fact the
original purchaser of the product from Atlantic Shutter Systems.
